1. What data we process

We process the minimum data necessary to provide our service:

• Chat messages: Processed in real-time by our AI engines (Grok by xAI, DeepSeek). Messages are NOT stored on our servers after the response is generated.
• IP address: Used only for rate limiting (5 requests/day for free tier). Not logged or stored beyond the active session.
• Payment data (Pro users): Processed exclusively by Stripe. We store only your Stripe customer ID and email to manage your subscription. We never see or store credit card numbers.
• Consent preference: Stored locally in your browser (localStorage) to remember your cookie choice.

2. Legal basis (GDPR Art. 6)

• Contract performance (Art. 6(1)(b)): Processing chat messages to provide the AI companion service you requested.
• Legitimate interest (Art. 6(1)(f)): Rate limiting to prevent abuse; security measures.
• Consent (Art. 6(1)(a)): For any non-essential data processing (currently none).

3. Data processors

• xAI (Grok): Processes chat messages to generate responses. Based in USA. Transfer mechanism: Standard Contractual Clauses.
• DeepSeek: Processes chat messages to generate responses. Based in China. Transfer mechanism: Standard Contractual Clauses + supplementary measures.
• Stripe: Payment processing. PCI-DSS Level 1 certified. Based in USA/Ireland. EU data processed in EU.
• Railway: Server hosting. Based in USA. Transfer mechanism: Standard Contractual Clauses.
• GitHub (Microsoft): Static site hosting via GitHub Pages. Based in USA. EU-US Data Privacy Framework.

4. Your rights (GDPR Articles 15-22)

You have the right to:

5. Data retention

• Chat messages: Not retained (real-time processing only)
• Rate limit data: Cleared after 60 seconds
• Subscription data: Retained until account deletion or 30 days after subscription ends
• Consent records: Stored in your browser until you clear localStorage

6. Children

This service is not intended for persons under 16 years of age. We do not knowingly collect data from children.

7. Changes

We will notify users of material changes via the website. Continued use after notification constitutes acceptance.

1. Service description

amiHerbAI is an AI-powered informational companion for herbal and phytotherapy topics. It uses a dual-engine architecture (Grok + DeepSeek) to cross-verify responses.

2. Not medical advice

amiHerbAI does NOT provide medical advice, diagnosis, or treatment recommendations. All information is for educational and informational purposes only. Always consult a qualified healthcare professional before using herbal remedies, especially if you are pregnant, nursing, taking medications, or have a medical condition.

3. Accuracy

While our dual-engine system reduces confabulation, AI-generated responses may still contain errors. We display concordance information so you can judge reliability. When our engines disagree, we tell you honestly rather than guessing.

4. Subscriptions & payments

• Free tier: 5 questions/day, no account required
• Pro tier: €9.99/month (VAT included), billed monthly via Stripe
• Cancel anytime from your Stripe billing portal — no cancellation fees
• Refunds: 14-day cooling-off period per EU Consumer Rights Directive

5. Acceptable use

Do not use amiHerbAI to seek emergency medical advice, for self-diagnosis of serious conditions, or to replace professional healthcare. Do not attempt to circumvent rate limits or abuse the API.

6. Liability

To the maximum extent permitted by applicable law, amiHerbAI is provided "as is." We are not liable for any health outcomes resulting from information provided by the service. Applicable Romanian and EU consumer protection laws apply.

7. Governing law

These terms are governed by Romanian law. Disputes shall be resolved by the courts of Timișoara, Romania, without prejudice to your right to bring proceedings in your country of residence (EU Consumer Rights).

• Architecture: Dual-engine anti-confabulation — both models answer independently; responses are delivered only when they agree (trigram-cosine concordance ≥ 0.45 and no numeric conflicts)

How it works

When you send a message, both AI models generate independent responses. A concordance algorithm compares them:

• Agreement (≥0.45 cosine + no numeric conflict): Response delivered with "affirm" status
• Disagreement: Honest refusal — "my two sources don't agree"
• One engine down: Single response with "uncorroborated" warning
• Both engines down: Technical error message, no guessing

Limitations

• This system can produce incorrect information despite dual verification
• It cannot diagnose, prescribe, or replace professional medical advice
• Herbal information may not account for individual health conditions
• The system's knowledge has a training data cutoff and may not reflect the latest research
• Concordance between two models does not guarantee factual accuracy — it reduces but does not eliminate confabulation risk

Human oversight

Users must exercise their own judgment. The concordance score and engine information are displayed with every response to support informed decision-making. The system includes medical disclaimers and directs users to healthcare professionals for health concerns.
